These Terms and Conditions ("Terms") govern your access to and use of v5.myqr-menu.com, including our websites, applications, digital menus, QR code services, online ordering functionality, point-of-sale features, restaurant management tools, SMS services, and other related products and services (collectively, the "Services").
By accessing, registering for, or using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, you should not use the Services.
1. About MyQR Menu
MyQR Menu provides technology that allows restaurants, food-service businesses, merchants, and other organizations to create and manage digital menus and provide related services to their customers.
Depending on the features enabled by a merchant, the Services may include:
  • Digital restaurant menus
  • QR code menus
  • Online ordering
  • Dine-in ordering
  • Pickup and delivery ordering
  • Table ordering
  • Order management
  • Point-of-sale functionality
  • Kitchen order management
  • Customer receipts
  • SMS notifications
  • Payment integrations
  • Coupons and promotions
  • Restaurant management tools
  • Customer and staff management
  • Other related features
Certain features may be provided directly by third-party service providers.
2. Eligibility
You must be legally capable of entering into a binding agreement to use the Services.
If you use MyQR Menu on behalf of a company, restaurant, organization, or other entity, you represent that you have authority to accept these Terms on behalf of that entity.
3. User Accounts
Certain features require an account.
You agree to:
  • Provide accurate information
  • Keep your account information current
  • Maintain the confidentiality of your login credentials
  • Use reasonable security measures to protect your account
  • Notify us if you believe your account has been compromised
You are responsible for activity performed through your account unless such activity results from a security failure directly attributable to MyQR Menu.
You may not intentionally share administrator credentials with unauthorized individuals.
4. Restaurant and Merchant Accounts
Restaurants and businesses using MyQR Menu are responsible for the information and products they publish through the platform.
This includes, where applicable:
  • Menu items
  • Product descriptions
  • Ingredients
  • Prices
  • Taxes
  • Fees
  • Discounts
  • Availability
  • Business hours
  • Images
  • Allergen information
  • Delivery information
  • Pickup information
  • Restaurant policies
Merchants are responsible for ensuring that information presented to customers is accurate and complies with applicable laws.
5. Food, Products, and Services Offered by Restaurants
Unless specifically stated otherwise, MyQR Menu provides the technology used to facilitate transactions and does not manufacture, prepare, package, or deliver food sold by independently operated restaurants.
The applicable restaurant or merchant is responsible for:
  • Food preparation
  • Food quality
  • Food safety
  • Ingredients
  • Allergens
  • Product availability
  • Order accuracy
  • Customer service related to the order
  • Delivery or pickup fulfillment
  • Refunds associated with restaurant purchases
  • Compliance with applicable food-service regulations
Questions or complaints regarding a specific food order may need to be directed to the restaurant that fulfilled the order.
6. Allergies and Dietary Requirements
Restaurants are responsible for providing accurate ingredient and allergen information.
Customers with food allergies, sensitivities, dietary restrictions, or medical dietary requirements should contact the restaurant directly before placing an order.
MyQR Menu cannot guarantee that menu information submitted by a restaurant is complete or that food has been prepared without cross-contact with allergens.
7. Orders
When a customer submits an order through MyQR Menu, the order may be transmitted directly to the applicable restaurant or merchant.
Submission of an order does not necessarily guarantee acceptance.
A restaurant may reject or cancel an order because of circumstances including:
  • Product availability
  • Incorrect pricing
  • Technical problems
  • Store closure
  • Delivery limitations
  • Suspected fraud
  • Inability to fulfill the order
The applicable merchant is responsible for fulfilling accepted orders.
8. Prices, Taxes, and Fees
Prices displayed through MyQR Menu are generally established by the applicable merchant.
Depending on the transaction, additional amounts may include:
  • Sales taxes
  • Delivery fees
  • Service fees
  • Tips
  • Processing fees
  • Other charges disclosed before checkout
Merchants are responsible for configuring applicable product pricing and taxes unless MyQR Menu specifically provides those amounts directly.
9. Payments
Payments may be processed through third-party payment processors.
Depending on the merchant and selected payment method, payment providers may include credit card processors, digital wallets, or other payment services.
Use of a third-party payment service may also be governed by that provider's terms and privacy policies.
MyQR Menu does not guarantee the availability or continued operation of any specific third-party payment processor.
10. Refunds, Cancellations, and Disputes
Refund and cancellation policies for restaurant purchases are generally established by the applicable merchant.
Customers requesting:
  • An order cancellation
  • A refund
  • A replacement
  • A correction
  • A charge adjustment
should normally contact the restaurant or merchant responsible for the transaction.
MyQR Menu may provide technical assistance when appropriate but is not necessarily the merchant of record for transactions processed through the platform.

SMS and Text Messaging Terms

11. SMS Services
MyQR Menu may send text messages on behalf of MyQR Menu or businesses using the platform.
SMS messages may include:
  • Digital receipts
  • Order confirmations
  • Order status updates
  • Pickup notifications
  • Delivery notifications
  • Reservation or service notifications
  • Account notifications
  • Security notifications
  • Customer support messages
  • Other transactional communications authorized or requested by the user
12. SMS Consent
When you provide a mobile telephone number and choose or agree to receive text messages, you consent to receive applicable SMS communications at that number.
Consent applies only to the messaging purpose disclosed when the telephone number is collected.
Providing a telephone number solely for an order does not automatically authorize unrelated promotional marketing messages.
13. Transactional SMS Messages
Transactional messages relate directly to a service, purchase, order, account, or interaction.
For example, when you request that a receipt be sent by SMS, you authorize MyQR Menu and its messaging providers to send the requested receipt to the telephone number provided.
Other transactional messages may include:
  • "Your order has been received."
  • "Your order is ready for pickup."
  • "Your order is out for delivery."
  • "Here is your receipt."
  • Account or security-related messages
Message frequency depends on your transactions and use of the Services.
14. Promotional SMS Messages
Transactional SMS consent does not automatically constitute consent to receive marketing or promotional text messages.
If MyQR Menu or a participating restaurant offers promotional SMS communications, the customer may be asked to provide separate consent where required.
Promotional messages may include:
  • Special offers
  • Discounts
  • Coupons
  • Restaurant promotions
  • New product announcements
  • Marketing campaigns
Consent to receive promotional SMS messages is not a condition of purchasing goods or services unless otherwise permitted by applicable law.
15. SMS Message Frequency
Message frequency varies.
Customers who request only a receipt may receive one or a limited number of messages relating to that transaction.
Customers who subscribe to other messaging programs may receive additional messages according to the program disclosed at the time of enrollment.
16. Message and Data Rates
Message and data rates may apply.
Charges are determined by your wireless carrier and mobile service plan.
MyQR Menu is not responsible for charges imposed by your wireless carrier.
17. SMS Opt-Out
You may withdraw consent to applicable SMS communications at any time by replying:
STOP
Where supported, other recognized opt-out commands may include:
  • CANCEL
  • END
  • QUIT
  • UNSUBSCRIBE
  • OPT OUT
  • REVOKE
You may receive one final message confirming that your opt-out request has been processed.
After opting out, you will no longer receive messages covered by that messaging program unless you subsequently provide consent again.

19. Wireless Carriers
Wireless carriers are not liable for delayed or undelivered messages.
SMS delivery depends on factors outside MyQR Menu's control, including:
  • Carrier availability
  • Mobile network conditions
  • Device configuration
  • Telephone number validity
  • Messaging provider availability
We cannot guarantee delivery of every text message.
20. Mobile Information and SMS Privacy
Mobile telephone numbers and SMS consent information are handled in accordance with our Privacy Policy.
Mobile information, SMS opt-in information, and text messaging consent will not be sold, rented, transferred, or shared with third parties or affiliates for their own marketing or promotional purposes.
Information may be processed by telecommunications carriers and service providers only as necessary to provide the requested messaging services.

Platform Terms

21. Acceptable Use
You may not use MyQR Menu to:
  • Violate applicable laws or regulations
  • Commit fraud
  • Misrepresent your identity
  • Distribute malware or malicious software
  • Attempt unauthorized access to systems or accounts
  • Interfere with platform security
  • Circumvent access controls
  • Send spam or unauthorized messages
  • Conduct phishing activities
  • Collect personal information unlawfully
  • Upload illegal or infringing content
  • Use the Services in a manner intended to damage MyQR Menu or another user
We may suspend or terminate accounts that violate these requirements.
22. SMS and Messaging Compliance for Merchants
Restaurants and businesses using MyQR Menu's messaging functionality are responsible for using those features lawfully.
Merchants must not use MyQR Menu to send unauthorized text messages.
Where required, merchants must:
  • Obtain appropriate customer consent
  • Clearly explain what customers are subscribing to
  • Maintain evidence of consent
  • Honor opt-out requests
  • Avoid sending messages after consent has been withdrawn
  • Identify themselves appropriately
  • Comply with applicable telecommunications and consumer-protection requirements
MyQR Menu may suspend messaging functionality if we believe it is being used for spam, abuse, or unlawful communications.
23. Prohibited SMS Activity
The SMS Services may not be used for:
  • Unsolicited bulk messaging
  • Purchased contact lists without appropriate consent
  • Harvested telephone numbers
  • Misleading or fraudulent communications
  • Phishing
  • Illegal products or services
  • Content prohibited by telecommunications carriers
  • Attempts to evade carrier filtering or compliance systems
We reserve the right to immediately suspend messaging privileges when reasonably necessary to protect customers, carriers, or the platform.
24. Content Submitted to MyQR Menu
Merchants may upload content such as:
  • Logos
  • Photographs
  • Product descriptions
  • Restaurant information
  • Menu information
  • Promotional materials
You retain ownership of content that you own.
By uploading content to MyQR Menu, you grant us a limited, non-exclusive license to host, process, reproduce, resize, transmit, display, and otherwise use the content as necessary to provide the Services.
You represent that you have the necessary rights to use and upload the content.
25. Intellectual Property
Except for content provided by users or third parties, the MyQR Menu platform and associated materials may include proprietary:
  • Software
  • Source code
  • Designs
  • Interfaces
  • Graphics
  • Logos
  • Databases
  • Documentation
  • Features
  • Trademarks
These materials are protected by applicable intellectual property laws.
Nothing in these Terms transfers ownership of MyQR Menu intellectual property to users.
26. API and Integrations
MyQR Menu may provide APIs, webhooks, integrations, plugins, or other developer functionality.
Users of these features must:
  • Protect API credentials
  • Follow applicable documentation
  • Avoid excessive or abusive requests
  • Maintain the security of integrations
  • Use retrieved data only for authorized purposes
We may introduce reasonable technical limits to protect the availability and security of the platform.
27. Third-Party Services
MyQR Menu may integrate with external services such as:
  • Payment processors
  • SMS providers
  • Email providers
  • Hosting providers
  • Mapping services
  • Delivery providers
  • Analytics services
  • Other software platforms
We are not responsible for failures, outages, policies, or actions of independent third-party providers.
Use of third-party services may be subject to separate agreements between you and the applicable provider.
28. Service Availability
We strive to maintain reliable Services, but we do not guarantee uninterrupted availability.
The Services may occasionally be unavailable because of:
  • Maintenance
  • Software updates
  • Hardware failures
  • Network outages
  • Third-party service interruptions
  • Security incidents
  • Events outside our reasonable control
We may modify, update, replace, or discontinue individual features when reasonably necessary.
29. Updates to the Platform
We may make changes to the Services to:
  • Improve functionality
  • Add new features
  • Address security issues
  • Correct software errors
  • Maintain compatibility
  • Comply with legal or regulatory requirements
Certain features may change or become unavailable over time.
30. Subscription Plans and Paid Services
Some MyQR Menu features may require a paid subscription or other fee.
Applicable pricing, billing frequency, included features, and limitations will be disclosed when purchasing a paid service.
Unless otherwise stated, fees for Services already provided are non-refundable except where required by law or specifically provided in an applicable refund policy.
31. Account Suspension and Termination
We may suspend, limit, or terminate access to the Services if we reasonably believe an account:
  • Violates these Terms
  • Is being used fraudulently
  • Creates a security risk
  • Engages in abusive messaging
  • Violates applicable laws
  • Fails to pay applicable fees
  • Threatens the stability of the platform
Where appropriate, we may provide an opportunity to resolve the issue before termination.
32. User Termination
You may discontinue use of MyQR Menu at any time.
Restaurants or account holders may request account closure subject to:
  • Outstanding balances
  • Legal retention requirements
  • Active disputes
  • Required transaction records
  • Other obligations that survive account termination
33. Privacy
Your use of MyQR Menu is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, retain, protect, and disclose information.
By using the Services, you acknowledge that you have had an opportunity to review the Privacy Policy.
34. Security
We use reasonable administrative, technical, and organizational safeguards intended to protect the Services.
Users are also responsible for protecting their accounts and systems.
You must notify us promptly if you discover:
  • Unauthorized account access
  • Compromised credentials
  • A suspected security vulnerability
  • Unauthorized API access
35. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
We do not guarantee that:
  • The Services will always be uninterrupted
  • Every feature will always be available
  • The Services will be completely error-free
  • Every third-party integration will remain available
  • Every message, notification, or order transmission will always be successfully delivered
Nothing in this section limits rights that cannot legally be waived.
36. Limitation of Liability
To the maximum extent permitted by applicable law, MyQR Menu will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the use or inability to use the Services.
This may include loss resulting from:
  • Business interruption
  • Lost revenue
  • Lost profits
  • Lost data
  • Third-party service failures
  • Restaurant fulfillment issues
  • Delayed or undelivered SMS messages
  • Network failures
Nothing in these Terms excludes liability that cannot legally be excluded.
37. Indemnification
To the extent permitted by applicable law, businesses using MyQR Menu agree to defend, indemnify, and hold harmless MyQR Menu from claims arising from:
  • Their products or services
  • Their menu content
  • Their violation of applicable laws
  • Their unauthorized messaging activity
  • Their infringement of third-party rights
  • Their misuse of the Services
This provision applies only to the extent permitted by applicable law.
38. Changes to These Terms
We may update these Terms periodically.
When material changes are made, we may update the Effective Date and publish the revised Terms through our website.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
39. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
40. No Waiver
Failure by MyQR Menu to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
41. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for specific Services, constitute the agreement governing use of MyQR Menu.
